{"id":12513,"date":"2020-11-26T15:17:36","date_gmt":"2020-11-26T07:17:36","guid":{"rendered":"https:\/\/pintas-ip.com\/?p=12513"},"modified":"2022-04-06T15:29:51","modified_gmt":"2022-04-06T07:29:51","slug":"new-asean-common-guidelines-for-the-substantive-examination-of-trade-marks","status":"publish","type":"post","link":"https:\/\/pintas-ip.com\/cn\/new-asean-common-guidelines-for-the-substantive-examination-of-trade-marks\/","title":{"rendered":"NEW ASEAN COMMON GUIDELINES FOR THE SUBSTANTIVE EXAMINATION OF TRADE MARKS"},"content":{"rendered":"<p style=\"font-size:15px\">On 28 April 2020, the second edition of the ASEAN Common Guidelines for the Substantive Examination of Trade Marks was published on the ASEAN IP Portal website and on the ARISE+ IPR website.<\/p>\n\n\n\n<p><strong><u>#The ARISE+ IPR project<\/u><\/strong><\/p>\n\n\n\n<p style=\"font-size:15px\">The <a href=\"https:\/\/euipoeuf.eu\/en\/ariseplusipr\" target=\"_blank\" rel=\"noopener\">ARISE+ IPR project<\/a>, implemented by the EUIPO, has supported this multi-annual activity that brings closer together the practices of the EU and the IP Offices of Brunei Darussalam, Cambodia, Indonesia, Lao PDR, Malaysia, Myanmar, Philippines, Singapore, Thailand and Vietnam.<\/p>\n\n\n\n<p><strong><u>#ASEAN Common Guidelines for the Substantive Examination of Trade Marks<\/u><\/strong><\/p>\n\n\n\n<p style=\"font-size:15px\">The Common Guidelines were revised to incorporate relevant new standards that reflect best practices in trademark registration criteria, including topics where IP Offices converge on their practices while incorporating updated laws and regulations of each ASEAN Member State.<\/p>\n\n\n\n<p style=\"font-size:15px\">This new edition of the ASEAN Common Guidelines highlights the move towards the acceptability of non-traditional types of trademarks. In the past, the Common Guidelines only made references to marks that were \u2018visually perceptible.\u2019 In contrast, the updated version incorporates all marks that are \u2018perceptible,\u2019 including sound marks, smell marks, taste marks, and tactile marks. This change reflects the changing trademark landscape and ASEAN\u2019s making the necessary adaptations to account for this.<\/p>\n\n\n\n<p style=\"font-size:15px\"><em>Read the new ASEAN Common Guidelines for the Substantive Examination of Trade Marks <\/em><a href=\"https:\/\/www.aseanip.org\/Portals\/0\/ASEAN%20Common%20Guidelines%20for%20the%20Substantive%20Examination%20of%20Trademarks%20(Second%20Edition%202020).pdf?ver=2020-04-27-165835-007\" target=\"_blank\" rel=\"noopener\"><em>here<\/em><\/a><em>.<\/em><\/p>\n\n\n\n<p><strong><u>#New Criteria for the Common Guidelines<\/u><\/strong><\/p>\n\n\n\n<p style=\"font-size:15px\">Additionally, works to develop certain topics further have taken place, particularly by incorporating new criteria and explanatory examples to the Guidelines.
