Industrial Design Applications Accepted by Myanmar IP Department as of February 1, 2024.

The Myanmar Intellectual Property Department (IPD) has officially started accepting industrial design applications under the Industrial Design Law as of the 1st of February 2024.

The IPD made a public announcement  on the 31st of January 2024, which is three months from the date the Industrial Design Law entered into force (October 31, 2023). The Industrial Design Rules had already been issued by the Myanmar Ministry of Commerce (MOC) on the 29th of September 2023 which lays out the procedure and guidelines for the registration of industrial design under the Industrial Design Law. On the 27th of October 2023, the MOC issued Notification No. 71/2023 of which specifies the required forms and actions involved for an industrial design, whereas the IP Agency specified the fees under Notification No. 2/2023 on the 29th of December 2023.

An industrial design application can be filed with the Myanmar IPD electronically, in person or by post. Under the Industrial Design Law, for an application to be registered, the industrial design must be “new”, whereby the design in question must not have been disclosed to the public whether locally or internationally prior to the application date.

As the IPD has started accepting applications, interested parties who wish to seek statutory protection of their industrial design in Myanmar can now begin the process of preparing all relevant documents and information for filing.
